BEAUMONT, TX – A 45-year-old Dayton, Texas man is facing serious time behind bars after admitting to a federal firearms violation. Michael Leonard Cupp pleaded guilty today, adding another layer to a criminal history already stained with a prior conviction.
According to court records, the bust went down November 12, 2019, when law enforcement moved in on Cupp at a Dayton residence, executing an arrest warrant originating from Calcasieu Parish, Louisiana. The original warrant stemmed from a string of ATM thefts plaguing the Lake Charles area. But the raid uncovered more than just a suspect – a stolen firearm was discovered in plain sight inside the living room.
Cupp’s past caught up with him quickly. He was previously convicted of engaging in organized criminal activity in Polk County, Texas, back in 2004. That conviction permanently bars him from possessing firearms or ammunition under federal law. The discovery of the stolen gun sealed his fate, triggering a federal indictment on December 4, 2019.
Now, Cupp is looking at up to 10 years in federal prison. While the maximum sentence is set by Congress, the actual punishment will be determined by the judge, taking into account sentencing guidelines and other relevant factors. A presentence investigation will be conducted by the U.S. Probation Office before a sentencing hearing is scheduled.
This case isn’t an isolated incident. It’s part of Project Guardian, a Department of Justice initiative aimed at cracking down on gun violence and enforcing federal firearms laws. The program focuses on coordinating federal, state, and local agencies to investigate and prosecute gun crimes, and improving information sharing to prevent prohibited individuals from acquiring weapons.
The U.S. Attorney’s Office is handling the prosecution, with crucial support from a multi-agency task force including the FBI, ATF, Liberty County Sheriff’s Office, Dayton Police Department, Calcasieu Parish Sheriff’s Office, and the FBI Lab in Quantico, VA.
