A Vestavia man is facing serious charges after being accused of being a felon in possession of firearms. Demarcus Marshall, 27, was indicted by a federal grand jury on two counts of possession of a firearm by a prohibited person.
According to the indictment, Marshall is prohibited from having a firearm because of prior felony convictions. He is accused of unlawfully possessing a Taurus 9mm pistol on September 9, 2020, and a Taurus .40 caliber pistol and Springfield 9mm pistol on September 30, 2020.
The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) along with the Birmingham Police Department and Homewood Police Department. Assistant U.S. Attorney Kristy Peoples is prosecuting the case.
Marshall faces a maximum penalty of 10 years in prison and a fine up to $250,000.
This case is part of Project Safe Neighborhoods (PSN), the centerpiece of the federal government’s violent crime reduction efforts. PSN is an evidence-based program proven to be effective at reducing violent crime.
An indictment contains only charges. A defendant is presumed innocent unless and until proven guilty.
