Assault with a Dangerous Weapon Lands Laguna Pueblo Man 30 Months in Prison

Dennis George Cheresposy, a 49-year-old resident of the Pueblo of Laguna, has been sentenced to 30 months in federal prison for his conviction on two assault charges. The sentence was handed down by a federal court, after Cheresposy’s guilty plea on July 30, 2013, to Count 2 of the indictment, charging him with assault resulting in serious bodily injury, and a felony information charging him with using his hands and feet to assault a second man.

According to the indictment, Cheresposy used his fists and boots to assault a man on October 20, 2011, causing the victim to suffer serious injuries. He also admitted to kicking and punching another Laguna Pueblo man on May 3, 2012, resulting in a fractured eye orbit and bulging disc.

The assaults occurred within the Pueblo of Laguna, and were investigated by the Laguna Agency of the Bureau of Indian Affairs’ Office of Justice Services and the Pueblo of Laguna Police Department. Assistant U.S. Attorney Elaine Y. Ramirez is prosecuting the case.

The court has deferred ruling on the amount of restitution Cheresposy will be required to pay to cover the costs of medical treatment for the victims. The sentence was announced by Acting U.S. Attorney Steven C. Yarbrough and DuWayne W. Honahni, Sr., Special Agent in Charge of District IV of BIA’s Office of Justice Services.

Cheresposy was arrested on January 18, 2013, on a two-count indictment charging him with assault with a dangerous weapon, and assault resulting in serious bodily injury. His guilty plea marked the end of a lengthy investigation and prosecution.

The case highlights the ongoing issue of violence on Native American reservations, and the efforts of law enforcement agencies to address these crimes. As the investigation and prosecution of Cheresposy demonstrate, those who commit violent crimes will be held accountable for their actions.
