Felony Charges Caught Up with Derbie Michel, Troy Resident
ALBANY, NEW YORK – Derbie Michel, a 33-year-old from Troy, New York, was sentenced today to 63 months in prison for illegally possessing ammunition as a convicted felon. He was previously found guilty and admitted to the crime.
Michel, who has three prior felony convictions, threw five rounds of ammunition from a car while fleeing from the Troy Police Department on October 15, 2022. He also threw a privately made firearm, or “ghost gun,” from the car during the same pursuit, according to court documents. This incident occurred in his hometown of Troy, New York.
Senior United States District Judge Frederick J. Scullin, Jr. imposed the sentence on Michel and found that he recklessly endangered others by instructing the driver of the car to engage in the car chase. Judge Scullin also ordered Michel to serve a 3-year term of supervised release upon Michel’s release from prison. Additionally, the judge found that Michel later obstructed justice by making materially false statements about that conduct in connection with his sentencing.
The FBI’s Capital District Safe Streets Gang Task Force, which includes FBI Special Agents and members of state and local law enforcement agencies, including the Troy Police Department, investigated the case. The U.S. Marshals Service and the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) assisted in the investigation. Assistant U.S. Attorneys Joshua R. Rosenthal and Allen J. Vickey prosecuted the case.
Michel’s crime put the community at risk, and the court has addressed the severity of his actions. The investigation and prosecution of this case demonstrate the commitment to public safety and the rule of law. As a convicted felon, Michel was not permitted to possess ammunition, and his actions disregarded this law.
The details of this case serve as a reminder of the importance of following the law and the consequences of breaking it. Michel’s sentence is a result of his actions and the thorough investigation and prosecution of this case.
