Felon from Ellwood City Pleads Guilty to Fentanyl Trafficking Charges

A convicted felon from Ellwood City, Pennsylvania, has pleaded guilty to charges of distributing fentanyl and illegally possessing firearms and ammunition. Derick Davare, 32, entered his guilty plea in federal court before United States District Judge Arthur J. Schwab.

According to court documents, Davare conspired with others to distribute and possess with intent to distribute 400 grams or more of fentanyl, a Schedule II controlled substance, between 2015 and October 22, 2018. Additionally, on October 22, 2018, Davare was found to be in possession of two firearms, including a F.N. Five-Seven pistol and a Sig-Sauer P226 pistol with an obliterated serial number, as well as ammunition.

Federal law prohibits individuals convicted of a crime punishable by more than one year of imprisonment from possessing firearms or ammunition. Davare was previously convicted of a crime, making him ineligible to possess these items.

The guilty plea was announced by United States Attorney Scott W. Brady. Assistant United States Attorneys Brendan T. Conway and Marnie Sheehan-Balchon are prosecuting the case on behalf of the government.

A federally administered Organized Crime and Drug Enforcement Task Force (OCDETF) conducted the investigation that led to Davare’s prosecution. The task force is comprised of members from the Drug Enforcement Administration, Internal Revenue Service – Criminal Investigation, and other law enforcement agencies.

Under the Federal Sentencing Guidelines, Davare faces a sentence of not less than ten years in prison and not more than life in prison, as well as a fine of $15,500,000. Sentencing has been scheduled for September 20, 2019, at 9 a.m.
