Belleville Man Convicted of False Tax Refund Claims
A 47-year-old Belleville man has been convicted of filing false claims for federal tax refunds, following a two-day jury trial in federal district court.
Destry Marcotte, of Belleville, Illinois, was found guilty of four counts of making false claims for federal tax refunds. The total amount claimed exceeded $600,000.
Prosecutors say Marcotte claimed to be a sovereign citizen, which he believed made him exempt from tax laws in the United States. However, evidence presented at trial showed that Marcotte was advised prior to making the false claims that his arguments were frivolous and could lead to criminal prosecution.
Marcotte was taken into custody after the jury’s verdict and is being held without bond until his sentencing, scheduled for January 17, 2014.
The successful prosecution is the result of an investigation by the Criminal Investigations Division of the Internal Revenue Service. Assistant United States Attorney Norman Smith handled the prosecution.
Marcotte faces up to 20 years in prison for his crimes. He has been detained awaiting sentencing, and his current status is being held without bond.
