American Canyon, CA – A former environmental manager for a Coca-Cola subsidiary has been sentenced to federal prison for directing a scheme to falsify wastewater discharge reports, the Department of Justice announced. Dhiren Patel, 43, was sentenced on June 22, 2011, to four months incarceration and twelve months probation after pleading guilty to violating the Clean Water Act.
Patel, who served as the Environmental, Health & Safety manager for AMCAN Beverages, Inc. from 2004 to 2007, orchestrated a deliberate effort to mislead regulators by diluting wastewater samples before they were sent for testing. He then submitted falsified reports to the City of American Canyon, falsely demonstrating compliance with the plant’s Clean Water Act permit. This manipulation concealed elevated levels of pollutants – specifically Biological Oxygen Demand (BOD) and Total Suspended Solids (TSS) – discharged from the AMCAN facility.
The scheme unraveled in the spring of 2007 when the City of American Canyon’s wastewater treatment plant began experiencing operational difficulties related to high BOD and TSS levels. Suspecting foul play, the city initiated covert monitoring of industrial dischargers, including AMCAN. These independent tests revealed significant discrepancies between AMCAN’s reported results and the actual concentration of pollutants being released into the sewer system, ultimately exposing Patel’s fraudulent activity.
Investigation and Prosecution
The case was the result of a year-long investigation by the United States Environmental Protection Agency’s Office of Criminal Enforcement. Federal prosecutors presented evidence showing Patel knowingly directed employees to add distilled or tap water to wastewater samples to lower the reported levels of pollutants. The falsified data was then used to avoid potential fines and regulatory scrutiny.
The City of American Canyon’s treatment plant was negatively impacted by AMCAN’s illegal discharges, even incurring its own violations of the Clean Water Act and associated fines. AMCAN itself entered into a settlement with the city in 2009 and cooperated with the government’s investigation. However, Patel remained the target of criminal prosecution for his role in directing the deceptive practices.
Sentencing and Aftermath
U.S. District Court Judge William Alsup imposed the four-month prison sentence, along with 12 months of probation, 100 hours of community service focused on environmental issues, and a requirement for Patel to deliver presentations to other environmental managers detailing the circumstances of his conviction. “The Bay Area, like other communities, relies on complete and accurate reporting about discharges of pollution to protect its people and its environment,” stated Nick Torres, Special Agent-in-Charge of EPA’s Criminal Investigation Division for the California region. “EPA takes allegations that waste water samples have been tampered with very seriously.”
