Arthur Taken Alive, a 45-year-old man from Little Eagle, South Dakota, has been sentenced for his role in a brutal domestic assault case that shook the small community.
According to court records, Taken Alive was convicted of Domestic Assault by Habitual Offender and was sentenced to 18 months in custody, 4 years of supervised release, $1,987.04 in restitution, and a $100 special assessment by US District Judge Charles B. Kornmann on January 4, 2013.
The assault, which took place in May 2011, left the victim with serious bodily injuries. Taken Alive struck the victim in the face with his fist, an act that would prove to be the catalyst for the lengthy sentence he is now serving.
But this was not Taken Alive’s first brush with the law. Prior to the incident, he had been convicted of domestic violence in tribal court at least twice.
Assistant US Attorney Mikal Hanson prosecuted the case, which was investigated by the Bureau of Indian Affairs, Standing Rock Agency. US Attorney Brendan V. Johnson announced the sentencing, marking a significant victory in the fight against domestic violence in South Dakota.
