BOSTON – The grim streets of Chelsea were once again the scene of justice as Dawin Hereaux-Pena, a 30-year-old Dominican national, faced an ominous charge. Hereaux-Pena, who was unlawfully residing in Chelsea, has been indicted for what amounts to a brazen defiance of American law: illegal reentry into the United States after being deported.
Hereaux-Pena’s journey back to the U.S., a perilous path for any immigrant facing such charges, began on February 5, 2019, when he was forcibly sent back to the Dominican Republic. But it seems that the promise of freedom in his home country was short-lived as Hereaux-Pena reportedly returned to America, this time under the shroud of lawlessness.
The defendant’s latest arrest came on May 29, 2025, in Chelsea. With charges formally laid down against him, Hereaux-Pena now faces a potential sentence that could shackle him for up to two years behind bars and saddle him with a fine of $250,000. That’s not all; his supervised release could last a year after serving any prison time.
United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston, stood together to announce the charges against Hereaux-Pena. Assistant U.S. Attorney Fred M. Wyshak of the Organized Crime & Gang Unit will be prosecuting this case, a testament to the severity of the defendant’s actions.
As per standard procedure, the allegations contained in the charging documents are merely that: allegations. Hereaux-Pena is presumed innocent until proven guilty beyond a reasonable doubt in a court of law, where sentences will be determined based on U.S. Sentencing Guidelines and statutes governing criminal cases.
