New York doctor Gerald Surya, 47, of New Hyde Park, pleaded guilty today to a brazen scheme of falsifying medical certifications for commercial drivers—signing off on physicals he never conducted, putting public safety on the line for profit. The defendant, once authorized to certify drivers under federal regulations, admitted to rubber-stamping clean bills of health for applicants who never saw him, let alone underwent proper medical screening.
According to court filings unsealed today, Surya claimed to have examined drivers applying for commercial driver’s licenses (CDLs) at his office near John F. Kennedy International Airport in Queens. In reality, untrained staff—lacking medical credentials and USDOT authorization—conducted cursory or no exams at all. Surya then certified these applicants as physically fit to operate massive trucks and school buses, directly violating federal safety mandates set by the U.S. Department of Transportation (USDOT).
Under USDOT rules, CDL applicants must pass written and road tests and undergo a medical exam by an approved examiner. The certification must then be filed with the New York State DMV. Certified examiners like Surya are also required to electronically submit copies of each certification monthly. Instead, Surya ignored protocol, allowing unqualified personnel to handle medical assessments while he signed off from behind a desk.
The fraud came to light during a federal investigation led by the USDOT-Office of Inspector General (OIG), which uncovered a paper trail of certifications issued without legitimate exams. The scheme not only undermined transportation safety but also breached the trust placed in licensed medical professionals tasked with protecting the public from impaired or unfit drivers.
Surya entered his guilty plea before United States District Judge LeShann DeArcy Hall in the Eastern District of New York. U.S. Attorney Robert L. Capers and USDOT-OIG Regional Special Agent-in-Charge Douglas Shoemaker announced the charges. The prosecution is being handled by Assistant U.S. Attorney Michael H. Warren of the Public Integrity Section.
GERALD SURYA, E.D.N.Y. Docket No. 16-CR-194 (LDH), now faces a maximum sentence of 15 years in federal prison when sentenced. The case underscores growing federal scrutiny of medical certification abuse in the commercial trucking and transit industries—where forgeries can have deadly consequences on America’s highways.
