David Jesus Pagan, Cocaine Trafficking, New York 2024

BUFFALO, N.Y. – David Jesus Pagan, 40, of Dunkirk, New York, is headed to federal prison for nearly a decade. Pagan was sentenced to 97 months – eight years and one month – by U.S. District Judge Elizabeth A. Wolford after being convicted of leading a large-scale cocaine trafficking operation and illegally possessing a firearm. The case, pursued by Acting U.S. Attorney James P. Kennedy, Jr., brings down a key figure in the drug trade that plagued the Dunkirk area for over two years.

According to Assistant U.S. Attorney Michael J. Adler, Pagan, along with co-defendant Rafael Burgos, orchestrated the distribution of multiple kilograms of cocaine throughout Dunkirk between 2013 and June 10, 2015. This wasn’t small-time dealing; Pagan and Burgos weren’t just moving weight, they controlled the flow. The operation was sophisticated enough to require a secret room dedicated to counting the profits – found during a search of Burgos’ residence, complete with a money-counting machine.

The bust went down in June 2015, with Pagan and Burgos among six individuals arrested. Law enforcement didn’t just find drugs; they hit the jackpot. Searches of six properties yielded over seven kilograms of cocaine – the largest cocaine seizure ever recorded in the City of Dunkirk – and a staggering $175,000 in cash. Adding insult to injury, authorities also recovered an AR-15 assault rifle with a fully loaded 30-round magazine, primarily from Pagan’s own home. This wasn’t just about profit; it was about power, and Pagan was armed to maintain it.

The investigation wasn’t a solo effort. The Drug Enforcement Administration, led by Special Agent-in-Charge James J. Hunt, spearheaded the probe, with crucial support from the Dunkirk Police Department (Chief David C. Ortolano), the Chautauqua and Cattaraugus County Sheriff’s Offices (Sheriffs Joseph A. Gerace and Timothy S. Whitcomb, respectively), and the Chautauqua County District Attorney’s Office (Patrick Swanson). It was a multi-agency takedown, demonstrating a unified front against the drug trade in Western New York.

Pagan isn’t the only one facing consequences. All defendants involved in the conspiracy have now been convicted, signaling a significant disruption to the drug network operating in the region. While Pagan received the harshest sentence, his co-conspirators will also answer for their roles in flooding Dunkirk with cocaine. This case serves as a stark reminder that federal agencies are actively targeting drug traffickers and those who arm themselves to protect their illegal enterprises.

The sentencing of David Jesus Pagan sends a clear message: peddling poison and brandishing weapons won’t be tolerated. Grimy Times will continue to follow this case and report on the fallout from this major drug bust. Contact Barbara Burns at (716) 843-5817 for further inquiries.
