Dustin Red Fox, Burglary, Little Eagle SD, 2022

LITTLE EAGLE, SD – Dustin Jade Red Fox, 30, of Little Eagle, South Dakota, is headed to federal prison after being sentenced yesterday for a violent home invasion and attempted arson. U.S. District Judge Charles B. Kornmann handed down a 27-month sentence, followed by three years of supervised release, for the First-Degree Burglary.

The crime unfolded in June of 2022, on the Standing Rock Sioux Indian Reservation. According to court documents, Red Fox forcibly entered the home of a former dating partner, launching into a physical assault. The situation escalated when Red Fox attempted to set the residence ablaze by igniting a blanket on the stove.

Federal prosecutors detailed the brutality of the attack during the sentencing hearing. Red Fox was indicted by a federal grand jury in July 2022 and ultimately pleaded guilty on September 26, 2022. The $100 special assessment ordered by the Judge will be directed to the Federal Crime Victims Fund, a small measure of restitution for the trauma inflicted.

The investigation was a joint effort between the Bureau of Indian Affairs, Office of Justice Services, Standing Rock Agency, and the Bureau of Alcohol, Firearms, Tobacco and Explosives (ATF). Assistant U.S. Attorney Cameron J. Cook led the prosecution, securing the conviction and subsequent sentencing.

The quick response from federal agencies and the decisive sentencing sends a message that such violent acts, particularly within vulnerable communities like the Standing Rock Reservation, will not be tolerated. Red Fox was immediately taken into custody by the U.S. Marshals Service following the sentencing, beginning his 27-month term.

U.S. Attorney Alison J. Ramsdell’s office has been aggressively pursuing cases involving violence on tribal lands. This case underscores the commitment of federal law enforcement to protect residents of the Standing Rock Sioux Indian Reservation and bring perpetrators of violent crime to justice.
