Joseph Elsey, 26, of Eagle Butte, South Dakota, is facing federal charges after being indicted for assaulting a federal officer with his shod feet during the performance of her official duties. The incident occurred on October 26, 2020, near Eagle Butte, according to the U.S. Attorney’s Office.
The federal grand jury returned the indictment on November 9, 2021. Elsey appeared before a U.S. Magistrate Judge on November 12, 2021, where he formally pleaded not guilty. The charge carries a maximum penalty of up to 20 years in federal prison and/or a $250,000 fine, three years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund. The court may also impose restitution.
Prosecutors allege that Elsey used his shod feet as a dangerous weapon during the attack on the federal officer. The indictment specifies that the assault occurred while the officer was lawfully carrying out her duties, a key element in elevating the charge to a federal offense.
