Eagle Butte Man Charged with Firearm Possession
An Eagle Butte man is behind bars, accused of possessing a firearm despite being a prohibited person, according to federal authorities.
Philip Nordvold, 36, was indicted by a federal grand jury on August 19, 2014, on charges of Possession of a Firearm by a Prohibited Person.
Nordvold appeared before U.S. Magistrate Judge Mark A. Moreno on August 22, 2014, and pleaded not guilty to the indictment.
The maximum penalty upon conviction is 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The indictment alleges that Nordvold, having previously been convicted of a crime punishable by imprisonment for more than one year, knowingly received and possessed a firearm on or about February 22, 2014.
The charge is merely an accusation, and Nordvold is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Services, with Assistant U.S. Attorney Mikal Hanson prosecuting the case.
Nordvold was remanded to the custody of the U.S. Marshals Service pending trial, with a trial date yet to be set.
