Eagle Butte Man Sentenced for Assaulting a Minor

David Roberts, Jr., 30, of Eagle Butte, South Dakota, was sentenced to 1 year of probation and fined $1,000, plus a $25 special assessment to the Federal Crime Victims Fund, for assaulting a minor. The conviction stems from a July 2012 incident in which Roberts, Jr. became upset at the infant’s behavior and engaged in an open-handed slap to his face.

The assault left a large handprint bruise on the baby’s cheek. Roberts, Jr. was indicted by a federal grand jury on February 13, 2013, and pled guilty to the charge of Assault of a Minor on April 24, 2013.

U.S. Magistrate Judge Mark A. Moreno handed down the sentence on June 27, 2013. The investigation was conducted by the Cheyenne River Sioux Tribe Law Enforcement Division, with the case being prosecuted by Assistant U.S. Attorney Mikal Hanson.
