Michael Charlton, 18, of Eagle Butte, South Dakota, is facing federal charges after being indicted for breaking into Suds-N-Snacks and stealing more than $1,000 in cash. The burglary occurred on January 29, 2019, when Charlton allegedly forced entry into the business and took U.S. currency from inside the premises.

On April 9, 2019, a federal grand jury returned the indictment charging Charlton with Third-Degree Burglary and Larceny. He appeared before U.S. Magistrate Judge Mark A. Moreno on April 16, 2019, entering a plea of not guilty. The prosecution is being handled by Assistant U.S. Attorney Cameron J. Cook.

If convicted, Charlton faces up to 5 years in federal prison and a fine of up to $250,000. Additional penalties include 3 years of supervised release, a mandatory $100 payment to the Federal Crime Victims Fund, and possible restitution to the business owner.

The investigation was led by the Cheyenne River Sioux Tribe Law Enforcement Services, working in coordination with federal authorities. No weapons were reported used in the crime, but the incident has rattled the tight-knit community where such break-ins are rare.

Charlton was released pending trial, which has been scheduled for June 18, 2019. The Department of Justice reminds the public that the charge is an accusation, and Michael Charlton is presumed innocent until proven guilty in a court of law.
