United States Attorney Randolph J. Seiler has announced a stunning turn of events in the small community of Eagle Butte, South Dakota. Three local residents have been hit with an unprecedented number of charges, facing federal indictment for a scheme that’s left many asking for justice.
Gillis Bear Stops, Jr., Chelsea White Eyes, also known as Chelsea Elk Eagle, and Daryl Eagle Horse, operating under the alias Daryl Hawk Eagle, all aged 40 and 29 respectively, have been charged with sixteen counts of Forgery and one count of Larceny. The trio was indicted on October 12, 2016, and appeared before U.S. Magistrate Judge Mark Moreno, where they entered not guilty pleas.
The charges are severe, with the potential for a heavy toll upon conviction. If found guilty, each defendant could face up to five years in custody and/or a $250,000 fine, along with three years of supervised release and a contribution of $100 to the Federal Crime Victims Fund. Additionally, restitution may be ordered.
The allegations against the defendants are as follows: between May 29, 2016, and August 27, 2016, they are accused of falsely making, completing, altering, or passing a total of 16 checks with the intent to defraud their victim. Their actions have been estimated to net them over $1,000 in cash.
It’s important to note that these charges are merely accusations, and each defendant is presumed innocent until proven guilty in a court of law.
The investigation into this matter has been led by the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Jay Miller is taking the lead on the prosecution of the case.
With their freedom hanging in the balance, Gillis Bear Stops, Jr., Chelsea White Eyes, and Daryl Eagle Horse have been released under conditions pending trial. The trial has been scheduled for December 31, 2016, setting the stage for a tense confrontation in the courtroom.
