Joshua Heideman, First Degree Burglary, South Dakota 2017

United States Attorney Randolph J. Seiler has announced the arrest of three individuals from Eagle Butte, South Dakota, on serious federal charges. Joshua Heideman, age 24, Tristan Yellow Horse, age 31, and Nicole Condon, a/k/a Nicole Garreau, a/k/a Nicole Yellow Horse, age 39, have been indicted for First Degree Burglary and Larceny.

Heideman and Yellow Horse are both residents of Eagle Butte. The woman, also from the same town, has been identified under three different names in legal documents. Their alleged crime took place on October 8, 2016, when they reportedly entered a residence with intent to steal property.

The trio faced their first hearings in early 2017. Yellow Horse appeared before U.S. Magistrate Judge Mark A. Moreno on February 27, 2017, and pleaded not guilty. Condon stood before the same judge on January 30, 2017, also entering a not guilty plea.

Heideman’s case took a different turn when he appeared before U.S. District Court Judge Roberto A. Lange on March 22, 2017. He pleaded guilty to First Degree Burglary and is scheduled for sentencing on June 5, 2017. The presentence investigation report was ordered in his case.

The Indictment outlines the maximum penalties that could be imposed upon conviction: up to 25 years in custody and/or a $250,000 fine, 5 years of supervised release, and an order of restitution. The charges against Yellow Horse and Condon are mere accusations, and they are presumed innocent until proven guilty.

This investigation is the result of extensive work by the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Jay Miller is handling the prosecution. Both Yellow Horse and Condon have been remanded to the custody of the U.S. Marshals Service. Their jury trial has been scheduled for July 25, 2017.
