OAKLAND – In a shocking turn of events, Victor Covian-Perez, a 23-year-old Oakland resident, was handed a 36-month prison sentence for being an alien in possession of a firearm and ammunition.
According to sources, Covian-Perez pleaded guilty to the firearm charge on July 18, 2019. As part of his plea agreement, he admitted to possessing three firearms and numerous rounds of ammunition, including a semi-automatic Springfield Armory XD .45 caliber handgun and two Charter Arms .38 caliber revolvers, on November 29, 2018.
At the time of his arrest, Covian-Perez was unlawfully in the United States and not eligible to possess a firearm or ammunition. He further admitted to selling approximately fifteen additional firearms between June and November 2018 to individuals whose possession of a firearm would be illegal.
On July 16, 2019, Covian-Perez was charged by superseding indictment with being an alien in possession of a firearm, in violation of 18 U.S.C. § 922(g)(5). He pleaded guilty to the charge and was subsequently sentenced by the Honorable Yvonne Gonzalez Rogers, United States District Judge.
In addition to the prison term, Judge Gonzalez Rogers ordered Covian-Perez to serve a three-year term of supervised release to begin at the conclusion of his prison term. Assistant United States Attorney Thomas R. Green is prosecuting the case with the assistance of Jessica Rodriguez. The prosecution is the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF).
This conviction serves as a stark reminder of the consequences of firearms trafficking. As our community continues to grapple with violence and gun-related crimes, it is imperative that we hold those responsible accountable for their actions.
