Ehab Abdulmutta Jaber, Possession of Firearms by a Prohibited Person, South Dakota 2017

A Sioux Falls, South Dakota, man has been indicted by a federal grand jury for Possession of Firearms by a Prohibited Person, according to an announcement made by United States Attorney Randolph J. Seiler.

Ehab Abdulmutta Jaber, age 46, was indicted on May 9, 2017. He appeared before U.S. Magistrate Judge Veronica L. Duffy on May 19, 2017, and pled not guilty to the Indictment.

The maximum penalty upon conviction is up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. This severe penalty reflects the seriousness of the charge, which alleges that Jaber unlawfully possessed five firearms between April 9, 2017, and April 21, 2017.

It is alleged that Jaber cannot legally possess firearms because he is an unlawful user of, and addicted to, a controlled substance. The investigation is being conducted by the Sioux Falls Police Department, Federal Bureau of Investigation, and the Bureau of Alcohol, Tobacco, Firearms and Explosives. Criminal Chief Dennis R. Holmes is prosecuting the case.

Jaber was remanded to the custody of the U.S. Marshals Service pending trial, which has been set for July 25, 2017. The charge is merely an accusation and Jaber is presumed innocent until and unless proven guilty. As the case moves forward, the prosecution will need to prove that Jaber knowingly and intentionally possessed the firearms while being prohibited from doing so.
