HARRISBURG — A violent confrontation with federal agents has landed Jose Luis Benitez-Hernandez, 30, an El Salvadoran national, behind bars for 14 months. The Middle District of Pennsylvania U.S. Attorney’s Office confirmed the sentence handed down by U.S. District Court Judge William W. Caldwell, stemming from Benitez-Hernandez’s aggressive resistance to deportation and physical assault of Immigration and Customs Enforcement (ICE) officers.
The assault unfolded in February 2016 in Mechanicsburg, Pennsylvania, when ICE officers tracked down Benitez-Hernandez, who had ignored a final order of removal issued by an immigration judge. Surveillance confirmed him leaving his residence in a vehicle. Officers activated emergency lights and sirens in an attempt to stop him—Benitez-Hernandez ignored them completely, accelerating toward one of the agency’s vehicles.
Instead of surrendering, Benitez-Hernandez repeatedly charged at the ICE vehicle, slamming into its front bumper. The deliberate ramming created a dangerous scene on public roads, endangering both law enforcement and civilians. When officers finally boxed him in, he refused to exit the car, forcing agents to forcibly extract him—a move that triggered a violent physical struggle.
During the arrest, Benitez-Hernandez bit one ICE officer and scratched another, inflicting injuries that required medical documentation. Bodycam footage and witness testimony later corroborated the unprovoked nature of the attacks. The defendant offered no compliance, escalating a routine deportation check into a full-blown assault on federal agents.
On September 15, 2017, a jury convicted Benitez-Hernandez after a two-day trial on charges of hindering his removal from the United States and assaulting federal law enforcement officers. The prosecution, led by Assistant U.S. Attorneys Scott Ford and Daryl Bloom, built a damning case rooted in video evidence, medical reports, and officer testimony.
The investigation was conducted by U.S. Immigration and Customs Enforcement’s Removal Operations, underscoring the growing risks agents face during routine enforcement actions. Benitez-Hernandez now serves his 14-month sentence in federal custody, a consequence for defying lawful authority and attacking those enforcing U.S. immigration law.
