A Clifton Park man has pleaded guilty to possessing child pornography after a federal investigation uncovered explicit images on his phone.
Eric William Tompkins, 37, entered a guilty plea before Senior United States District Judge Thomas J. McAvoy in Albany Federal Court, admitting that he possessed child pornography images on his cellular phone on March 28, 2019.
The explicit images included depictions of prepubescent children, and Tompkins, a registered sex offender, faces at least 10 years and up to 20 years in prison when he is sentenced on December 15, 2021.
This case was investigated by the FBI and its Child Exploitation Task Force, with assistance from the United States Marshals Service and the New York State Police, and is being prosecuted by Assistant U.S. Attorney Rachel Williams.
This case is prosecuted as part of Project Safe Childhood, a federal initiative launched in May 2006 by the U.S. Attorney’s office to combat child exploitation and pornography. The goal of Project Safe Childhood is to better locate, apprehend, and prosecute individuals who exploit children via the Internet.
The U.S. Attorney’s office in Albany has worked to identify and rescue victims of child exploitation, and this case is a significant step in that effort. Tompkins’ guilty plea and impending sentence are a testament to the dedication of law enforcement and prosecutors in combating child exploitation.
Tompkins is set to be sentenced on December 15, 2021, and will face a term of supervised release of at least 5 years and up to life. The sentence will be imposed by the judge based on the particular statute Tompkins is charged with violating, the U.S. Sentencing Guidelines, and other factors.
