PITTSBURGH, PA – Ernest Lee Terry, 45, of McKees Rocks, is facing serious federal charges after being indicted by a grand jury for possession of a firearm despite a lengthy criminal record. The arrest, made on March 14, brings to light a pattern of alleged criminal behavior that authorities say poses a significant threat to public safety.
According to the indictment, Terry was found to be in possession of a .45 caliber Ruger semiautomatic pistol. This seemingly simple possession carries significant weight, given Terry’s history. He’s been convicted of seven prior felonies, including offenses related to drug trafficking and previous firearms violations. Federal law is clear: convicted felons are prohibited from owning or possessing firearms or ammunition.
Prosecutors are escalating the charges by designating Terry as an Armed Career Criminal, a designation that triggers enhanced penalties due to his extensive and repeated offenses. This isn’t a first-time offender situation; Terry has repeatedly demonstrated a disregard for the law, and authorities are seeking a substantial sentence to reflect that.
If convicted, Terry faces a mandatory minimum sentence of 15 years in prison, with the potential for a life sentence. He could also be ordered to pay a fine of up to $250,000. The actual sentence, however, will be determined based on the specifics of the case and Terry’s prior criminal history, as outlined in federal sentencing guidelines.
The case is being prosecuted by Assistant U.S. Attorneys Douglas C. Maloney and Vincent Joseph Sonson. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Allegheny County Police Department spearheaded the investigation, highlighting a collaborative effort to remove dangerous individuals and illegal firearms from the streets. This case is part of the Department of Justice’s “Project Safe Neighborhoods” initiative, a program aimed at reducing violent crime and gun violence through coordinated law enforcement efforts.
It’s crucial to remember that an indictment is merely an accusation. Terry is presumed innocent until proven guilty in a court of law. However, with a record of seven prior felonies, the stakes are incredibly high, and the outcome of this case will undoubtedly send a message about the consequences of illegal firearm possession and repeated criminal behavior in Western Pennsylvania.
