Derek Clemens, 31, of Evansdale, Iowa, is facing federal charges for the receipt and possession of child pornography, according to an indictment unsealed May 8, 2019, in U.S. District Court in Cedar Rapids. The charges mark the latest case in a broader federal crackdown on online child exploitation.
The indictment alleges that in 2018, Clemens knowingly received child pornography and later possessed it on a cell phone. Federal investigators say digital evidence recovered from the device formed the backbone of the case, linking Clemens directly to the illegal material.
If convicted, Clemens faces a mandatory minimum of 5 years in prison and a maximum of 40 years behind bars. He could also be fined up to $500,000 and subjected to a supervised release period of at least five years — potentially for life — following any prison term.
Clemens appeared in federal court on May 10, 2019, for a detention hearing and was ordered held without bond. Authorities deemed him a flight risk and a danger to the community. His trial is scheduled for July 8, 2019, in Cedar Rapids.
The case is being prosecuted by Assistant United States Attorney Mark Tremmel and investigated by the Iowa Division of Criminal Investigation and the Evansdale Police Department. It was brought as part of Project Safe Childhood, a Justice Department initiative launched in 2006 to combat the sexual exploitation of minors online.
As with all federal criminal cases, the charges against Derek Clemens are allegations. He is presumed innocent until proven guilty in a court of law.
