Kansas City Chiropractor Sentenced for Medicare Scam
A former chiropractor in Kansas City, Missouri, has been sentenced to 15 months in federal prison for bilking Medicare out of over $3 million in a brazen scam.
Michael Kelly Miller, 59, of Florida, pleaded guilty to health care fraud for submitting claims for nerve block injections that were not medically necessary. He was the owner of Waldo Rehabilitation Health & Wellness in Kansas City, Missouri, from 2009 to 2011.
Between February 2009 and December 2011, Miller’s clinic billed Medicare approximately $3,083,454, and Medicare paid the clinic approximately $879,582 for nerve block injections.
Prosecutors say Miller shifted his focus from chiropractic services to purportedly diagnosing and treating neuropathy, using nerve block injections that were not medically indicated. The clinic’s patients typically received the injections, along with other treatments, two or three times a week for four to eight weeks.
Miller’s patients were mostly Medicare beneficiaries, and most of the clinic’s revenues came from Medicare payments. However, Medicare does not cover experimental or investigational procedures, which is what the nerve block injections were.
Miller was sentenced by U.S. Chief District Judge Greg Kays and ordered to pay $879,582 in restitution to Medicare. He has also surrendered his chiropractic license as part of his plea agreement.
This case was prosecuted by Assistant U.S. Attorneys Cindi S. Woolery and Daniel M. Nelson, and investigated by the Department of Health and Human Services, Office of Inspector General and the FBI.
