Fabian Carlo Rodriguez, Failure to Register as a Sex Offender, South Dakota 2021

A 30-year-old Wakpala man is facing serious charges after failing to register as a sex offender. Fabian Carlo Rodriguez, a convicted sex offender, was indicted by a federal grand jury on November 9, 2021, for his alleged failure to properly register and update his registration between February 6, 2021, and July 28, 2021.

As a result of his November 2014 conviction for Sexual Abuse of a Minor, Rodriguez is required to register as a sex offender under the Sex Offender Registration and Notification Act. The U.S. Marshals Service is leading the investigation into Rodriguez’s alleged failure to comply with the law.

Rodriguez appeared before U.S. Magistrate Judge Mark A. Moreno on November 15, 2021, where he pleaded not guilty to the indictment. He was subsequently remanded to the custody of the U.S. Marshals Service pending trial, with a trial date yet to be set.

The maximum penalty for conviction is up to 10 years in federal prison, a $250,000 fine, 5 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.

Rodriguez’s case is being prosecuted by Assistant U.S. Attorney Cameron J. Cook. The alleged failure to register as a sex offender is a serious offense, and Rodriguez is presumed innocent until proven guilty.

The indictment serves as a reminder of the importance of complying with sex offender registration laws. The public has a right to know about convicted sex offenders in their community, and failure to register can have serious consequences.

The case against Rodriguez is ongoing, and further details will be released as more information becomes available.
