Rapid City Man Accused of Defying Sex Offender Laws
RAPID CITY, SD – Trevor Red Bird, 28, of Rapid City, is facing federal charges for allegedly failing to register as a sex offender, a violation of federal law. The indictment, handed down by a federal grand jury on March 15, 2017, alleges Red Bird knowingly disregarded his legal obligation to keep his registration current.
According to court documents, Red Bird was convicted of Abusive Sexual Contact in May 2008, triggering the requirement for him to register under the Sex Offender Registration and Notification Act (SORNA). The government alleges that between September 15, 2016, and November 8, 2016, Red Bird deliberately failed to properly register, despite being legally bound to do so.
U.S. Attorney Randolph J. Seiler announced the indictment, emphasizing the seriousness of the charges. “Compliance with sex offender registration laws is not optional,” Seiler stated. “It’s a critical component of public safety, and we will vigorously prosecute those who attempt to evade these requirements.”
Red Bird appeared before U.S. Magistrate Judge Mark A. Moreno on March 16, 2017, and entered a plea of not guilty. If convicted, he faces a maximum penalty of up to 10 years in prison and a fine of up to $250,000. Additionally, he could be subjected to between 5 years and life of supervised release, and a mandatory $100 contribution to the Federal Crime Victims Fund. Restitution may also be ordered by the court.
The investigation was a joint effort between the U.S. Marshals Service and the Rapid City Police Department, highlighting the collaborative approach to enforcing federal laws. Assistant U.S. Attorney Kirk Albertson is leading the prosecution of the case. Red Bird remains in the custody of the U.S. Marshals Service, awaiting a trial date which has not yet been scheduled.
