Eagle Butte Man Charged With Failure to Register as a Sex Offender

In a shocking turn of events, Denver Spotted Horse, a 30-year-old man from Eagle Butte, South Dakota, has been indicted by a federal grand jury for failure to register as a sex offender.

According to court documents, Spotted Horse had a prior conviction for sexual assault in Minnesota and was required to register as a sex offender. However, he allegedly failed to do so while living on the Cheyenne River Sioux Indian Reservation between July 1, 2013, and March 11, 2014.

The maximum penalty for conviction is up to 10 years in custody and/or a $250,000 fine, with a mandatory minimum period of at least 5 years of supervised release. In addition, Spotted Horse may be required to pay restitution and a $100 fine to the Federal Crime Victims Fund.

Spotted Horse is presumed innocent until proven guilty and will be required to appear before U.S. Magistrate Judge Mark A. Moreno for further proceedings. The investigation is being conducted by the U.S. Marshals Service and the Cheyenne River Sioux Tribe Law Enforcement Services, with Assistant U.S. Attorney Mikal Hanson prosecuting the case.
