Failure to Register as Sex Offender Lands Eagle Butte Man in Prison

Denver Spotted Horse, 31, of Eagle Butte, South Dakota, has been sentenced to 24 months of custody for his failure to register as a sex offender. U.S. District Judge Roberto A. Lange handed down the sentence on July 29, 2014.

Spotted Horse was convicted of the crime after he failed to register his new address on the Cheyenne River Sioux Indian Reservation. He had a prior conviction for sexual assault in Minnesota and knew he was required to register under the Sex Offender Registration and Notification Act.

Spotted Horse was living near Eagle Butte between July 1, 2013, and March 11, 2014, and knowingly failed to update his registration. He was indicted by a federal grand jury on March 11, 2014, and pled guilty to the indictment on May 12, 2014.

This case was investigated by the U.S. Marshals Service and the Cheyenne River Sioux Tribe Law Enforcement Service. Assistant U.S. Attorney Mikal Hanson prosecuted the case.

The 24-month sentence also includes 5 years of supervised release and a $100 special assessment to the Federal Crime Victims Fund. Spotted Horse was remanded to the custody of the U.S. Marshals Service to begin serving his sentence.
