HARRISBURG – The grim saga surrounding the death of Everett Palmer Jr. has reached a new chapter as federal officials have closed their review into the case. According to U.S. Attorney John C. Gurganus, there’s simply not enough evidence to press civil rights charges against York County Prison personnel.
Palmer met his fate following an emergency cell extraction after he exhibited self-injurious behavior. The medical examiner concluded that Palmer’s death was a direct result of complications from excited delirium, linked to methamphetamine toxicity, during physical restraint.
The feds scoured through mountains of evidence, including statements by corrections officers, witness accounts, video footage, and medical reports. Despite their diligent efforts, they found the evidence lacking to prove that corrections officers violated federal law by using unreasonable force or acting with deliberate indifference to Palmer’s medical needs.
Under federal criminal civil rights statute, prosecutors must meet a daunting standard: proving beyond a reasonable doubt that an officer willfully deprived an individual of constitutional rights. In this case, the evidence did not meet that threshold. The investigation has been closed, strictly due to the department’s inability to meet the high legal bar for prosecution.
The Justice Department stands firm in its commitment to investigating allegations of excessive force by law enforcement. However, it is crucial to note that this decision does not reflect an assessment of any other aspect of Palmer’s death. The agency remains vigilant and dedicated to ensuring full investigation of serious civil rights violations.
Despite the conclusion of this phase of the inquiry, questions about the circumstances surrounding Palmer’s tragic demise continue to linger. The U.S. Attorney’s Office for the Middle District of Pennsylvania promises that it will continue to pursue justice wherever evidence leads.
