A federal judge in Albany has found that Felix Strevell, a former state official, fraudulently transferred $85,706.61 to his daughter in an attempt to avoid paying federal restitution. According to the United States Attorney’s Office, Strevell diverted a total of $159,046.00 to his daughter between September 2012 and June 2014, instead of paying his court-ordered restitution of $111,500 to the State of New York.

Strevell, who served as the New York State Deputy Secretary of State from 1997 to 1999, was convicted of defrauding the state in 2009. His sentencing included a requirement to pay $111,500 in restitution. However, instead of paying, Strevell allegedly transferred the funds to his daughter, Nicole Childrose, a full-time college professor.

The Court found that Strevell had withdrawn cash from various business accounts and deposited it into his daughter’s personal bank account. The transactions were made from bank accounts that Strevell had hidden from the government. Additionally, when prosecutors deposed Strevell in 2014, he lied under oath about the financial support he provided to his daughter and the significant financial contributions he made to her 2014 wedding.

Strevell eventually pled guilty to five counts of perjury and admitted to giving his daughter more than $30,000.00 for wedding expenses. He is currently serving a 30-month prison term. The Court noted that neither Strevell nor his daughter presented any evidence to contradict the overwhelming evidence that Strevell had unjustly enriched his grown daughter instead of complying with his restitution obligation.

As a result of the investigation, the government began garnishing Strevell’s monthly New York State pension and applied those monies to his restitution obligation. By the time the United States moved for summary judgment against the defendants in February 2018, Strevell owed $85,706.61 in restitution.

United States Attorney Grant C. Jaquith stated, ‘Strevell cheated New York State taxpayers a second time by shirking his restitution obligation, hiding his assets and income, and funneling money to his adult daughter. As this case demonstrates, we will use every appropriate avenue to enforce restitution judgments and fight fraudulent efforts to forestall fulfillment of them.’
