DAVENPORT, IA – A Davenport man has been sentenced to five years in prison for a brazen display of gunfire in a parking lot.
On September 9, 2016, an off-duty Davenport police officer witnessed a fight in a parking lot and observed Marcus Anthony Brown, 27, fire two shots into the air from what appeared to be a handgun.
Brown, who was driving a vehicle, got in and out of it before leaving the scene, but officers were able to seize several rounds of .380 caliber ammunition from the vehicle.
Brown was subsequently arrested and charged with being a felon in possession of ammunition. He has two prior felony convictions from 2005.
Chief District Court Judge John A. Jarvey handed down the sentence on January 23, 2017, and ordered Brown to serve three years of supervised release and pay $100 to the Crime Victims’ Fund.
The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Davenport Police Department, and was prosecuted by the United States Attorney’s Office for the Southern District of Iowa.
The incident serves as a reminder of the dangers of carrying firearms and the consequences of being a felon in possession of such weapons.
According to the United States Attorney’s Office, Brown’s actions put the public at risk and demonstrated a reckless disregard for the law.
The case highlights the importance of community policing and the role that off-duty officers can play in maintaining public safety.
