Emilio Garcia-Cappas, 27, was indicted on one count of conspiracy to distribute 40 or more grams of fentanyl and one count of distribution and possession with intent to distribute fentanyl, following a multi-agency investigation.
The indictment alleges that between February 5, 2024, and February 22, 2024, Garcia-Cappas conspired with others to distribute and possess with intent to distribute 40 or more grams of fentanyl. Specifically, on February 12, 2024, Garcia-Cappas allegedly distributed and possessed with intent to distribute fentanyl.
According to court documents, the charge of conspiracy to distribute 40 grams or more of fentanyl provides for a sentence of at least five years and up to 40 years in prison, at least four years of supervised release, and a fine of up to $2 million. The charge of distributing and possessing with intent to distribute fentanyl provides for a sentence of up to 20 years in prison, up to three years of supervised release, and a fine of up to $1 million. The court will ultimately determine the sentence based on the U.S. Sentencing Guidelines and statutes governing the case.
Acting United States Attorney Joshua S. Levy, Springfield Police Superintendent Lawrence Akers, and United States Marshal Brian A. Kyes announced the arrest. Assistant U.S. Attorney Todd E. Newhouse of the Springfield Branch Office is prosecuting the case.
The details contained in the indictment are allegations, and Garcia-Cappas is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.
