Fischer’s Guilty Plea in Assault Case
A 22-year-old Lake Andes man has pleaded guilty to assaulting a man whose jaw was broken in the attack. Albert Fischer appeared before U.S. District Judge Karen E. Schreier on January 28, 2013, and entered the guilty plea.
According to court documents, Fischer assaulted the victim in July 2012, causing serious bodily injury. The maximum penalty upon conviction is 10 years’ imprisonment and a $250,000 fine.
The investigation into the assault was conducted by the Bureau of Indian Affairs Law Enforcement Services – Yankton Reservation, and the FBI. The case is being prosecuted by Assistant U.S. Attorney Thomas J. Wright.
A presentence investigation has been ordered, and a sentencing date has been set for April 22, 2013. Fischer was remanded to the custody of the U.S. Marshal pending sentencing.
