Clearwater, Florida, resident Cole Leggett, 52, admitted in federal court today to pushing unapproved performance enhancing drugs across state lines, feeding a black-market network that endangered public health, prosecutors say. The grim confession came in Clarksburg, West Virginia, where Leggett entered a guilty plea to one count of distributing misbranded pharmaceuticals.
Leggett operated as an employee of Freedom Pharma, a shadowy outfit that manufactured and shipped unapproved prescription drugs to customers nationwide—including deep into the Northern District of West Virginia. The company operated without registration from the U.S. Food and Drug Administration, flouting federal safety laws while flooding the market with untested, unlabeled substances.
The drugs in question—marketed as performance enhancers—were not only unapproved but also misbranded, meaning they carried false or missing labeling, dosage information, and safety warnings. By introducing these substances into interstate commerce, Leggett and his associates bypassed critical safeguards meant to protect American consumers from dangerous or ineffective medications.
“When criminals introduce misbranded drugs into the marketplace, they expose U.S. consumers to risk,” said Mark S. McCormack, Special Agent in Charge of the FDA’s Office of Criminal Investigations’ Metro Washington Office. “We will continue to pursue and bring to justice those who would jeopardize the health of the U.S. public.”
Now staring down a potential five-year federal prison sentence and a fine of up to $250,000, Leggett’s fate rests in the hands of U.S. Magistrate Judge Michael John Aloi, who presided over the hearing. Under Federal Sentencing Guidelines, the final penalty will hinge on the severity of the offense and any prior criminal history—details that could ratchet up the consequences.
The case was prosecuted by Assistant U.S. Attorney Jarod J. Douglas, with investigation led by the United States Food and Drug Administration. No co-conspirators have been named in the current filing, but sources indicate the probe into Freedom Pharma’s operations remains active.
