ASHEVILLE, N.C. – Richard Spencer Flynn, 41, of Tampa, Florida, will spend the next 16 years of his life behind bars for the systematic abuse and exploitation of a minor. U.S. District Court Judge Max O. Cogburn, Jr. handed down the 192-month sentence yesterday, a consequence for Flynn’s production of child pornography. The sentence doesn’t end there: Flynn will also face a lifetime of supervised release and mandatory registration as a sex offender upon his eventual release.
The case, spearheaded by the FBI and the Buncombe County Sheriff’s Office, revealed a chilling pattern of predatory behavior. According to court documents, beginning in March 2015 and continuing through March 2016, Flynn traveled from Florida to North Carolina with the explicit intent of meeting a 15-year-old girl he’d connected with online. This wasn’t a chance encounter; it was a calculated move to engage in illicit sexual conduct, documented through the creation of disturbing images of child pornography.
U.S. Attorney Jill Westmoreland Rose didn’t mince words in her assessment of Flynn’s actions. “Flynn was a predator lurking on the Internet who targeted a child for his deviant sexual purposes,” she stated. “His conduct was reprehensible and for that, he will deservedly serve time in federal prison.” The prosecution presented evidence showing Flynn not only met the victim but actively produced numerous images exploiting her, solidifying the gravity of his crimes.
Flynn initially pleaded guilty in December 2016 to one count of production of child pornography, a charge that carries significant weight under federal law. Judge Cogburn, echoing the severity of the offense, declared during sentencing, “This is a serious crime with a serious punishment.” The judgment sends a clear message: those who prey on children will face the full force of the legal system.
Flynn has been in custody since September 29, 2016, awaiting sentencing. He will now be transferred to a designated federal facility under the custody of the Federal Bureau of Prisons. Crucially, all federal sentences come without the possibility of parole, meaning Flynn will serve every single day of his 16-year sentence. This isn’t a system offering second chances to those who inflict such harm.

The successful prosecution of this case underscores the importance of collaboration between federal and local law enforcement agencies in protecting vulnerable children and bringing predators like Richard Spencer Flynn to justice.
