PHOENIX, Ariz. – A harrowing tale of human smuggling took a grim turn as Jorge Adan Fontes-Garcia, 26, from Sonora, Mexico, was sentenced to 130 months in federal prison for his role in an alien-smuggling operation that tragically resulted in death.
Fontes-Garcia pleaded guilty on May 20 to Bringing an Illegal Alien to the United States Unlawfully Resulting in Death. His sentence also includes 60 months of supervised release for violating federal supervision following a prior conviction for Reentry of an Illegal Alien.
The August 23, 2023, incident saw Fontes-Garcia as the guide leading eight aliens across the Mexico-United States border into southern Arizona. All but one were caught by the United States Border Patrol in the harsh desert environment south of Tacna, Ariz. Tragically, one of the aliens was found deceased due to excessive heat exposure.
‘This case demonstrates that human smugglers often have little regard for those entrusted to their care,’ said United States Attorney Timothy Courchaine. ‘Their actions are not just a violation of the law but can lead to tragic consequences.’
Chief Patrol Agent Justin De La Torre, Yuma Sector Border Patrol, echoed this sentiment: ‘Human smuggling results in numerous deaths every year as smugglers are more concerned with profit than the lives they are smuggling. This sentence sends a clear message to anyone considering smuggling foreign nationals into the country – “if you do, we will arrest you, and you will be held accountable.”’
This case is part of Operation Take Back America, a nationwide initiative aimed at repelling illegal immigration, eliminating cartels and transnational criminal organizations, and protecting communities from violent crime. It was investigated by the United States Border Patrol and prosecuted by the U.S. Attorney’s Office, District of Arizona.
