Fort Thompson Man Jailed for Assault

A Fort Thompson man was sentenced to 55 months in custody for assault on a woman he had been dating. Calvin Bagola, 27, was convicted of Assault Resulting in Substantial Bodily Injury to an Intimate Partner and Assault Resulting in Serious Bodily Injury.

On February 13, 2014, Bagola began assaulting his intimate partner, who had been in a relationship with him since September 2013. The assault occurred at his mother’s house, and the victim received medical treatment at the hospital in Chamberlain.

The victim suffered a mildly depressed medical orbital wall fracture and a non-displaced fracture involving the superolateral aspect of the right maxillary sinus. Both of her eyes were swollen shut, and she had bruising to her face and body.

Bagola was convicted of a second count of assault stemming from an incident on March 27, 2014, when he began assaulting the same victim. A second victim attempted to intervene and protect her, but Bagola assaulted her with a closed fist, punching her several times and knocking her to the ground unconscious.

The second victim required surgery to repair her injuries, including her mouth being wired shut for several weeks. She suffered fractures of the mandible both anteriorly and involving the left ramus.

U.S. Attorney Brendan V. Johnson announced the sentencing, which occurred on January 26, 2015. U.S. District Judge Roberto A. Lange sentenced Bagola to 55 months in custody on each count, with the sentences to be served concurrently. He also received 2 years of supervised release and a $200 special assessment to the Federal Crime Victims Fund.

Bagola was immediately turned over to the custody of the U.S. Marshals Service. The case was investigated by the Bureau of Indian Affairs, Crow Creek Agency, and Assistant U.S. Attorney Meghan N. Dilges prosecuted the case.
