Frank P. O’Toole, Selling Stolen Firearms, Massachusetts 2022

A brazen case of gun theft has come to light in Middleborough, Massachusetts, as a former FedEx driver pleaded guilty to selling three stolen firearms.

Frank P. O’Toole, 40, a resident of Middleborough, was arrested in August 2022 and charged with stealing and selling three firearms from FedEx packages he was responsible for delivering.

Between October 2021 and June 2022, O’Toole, who worked as a FedEx delivery truck driver out of a FedEx facility in Middleborough, stole three packages containing firearms intended for Federal Firearms Licensees.

On August 9, 2022, and August 12, 2022, O’Toole sold the three firearms to an undercover agent during two separate controlled purchases.

O’Toole now faces a maximum of 10 years in prison and a fine of up to $250,000 for his crimes. U.S. District Court Judge Angel Kelley has scheduled sentencing for September 26, 2023.

The investigation into O’Toole’s activities was a collaborative effort between the FBI, the Bureau of Alcohol, Tobacco, Firearms & Explosives, and the Middleborough Police Department.

O’Toole’s guilty plea brings an end to a case that highlights the importance of vigilant law enforcement in preventing the theft and sale of firearms.
