A McLaughlin, South Dakota, man was sentenced to 180 months in custody for Abusive Sexual Contact.
Frankie Marshall, 27, was convicted of Abusive Sexual Contact by Use of Force, Abusive Sexual Contact by Fear, and Abusive Sexual Contact.
The incident occurred on March 29, 2017, at the home of a friend, the victim, in Bullhead, South Dakota.
Marshall was at the home with the victim, where they were playing dice and cards. He left around 5:30 am to meet up with another person but returned shortly after and asked to wait for his sister to pick him up.
The victim declined Marshall’s offer of a one-night-stand, and he shoved her back on the couch, got on top of her, and attempted to shove his hands down her pants.
Marshall was arrested by the Bureau of Indian Affairs Law Enforcement in Fort Yates, North Dakota, after fleeing the scene and the police were summoned.
The case was investigated by the Bureau of Indian Affairs Standing Rock Agency and prosecuted by Assistant U.S. Attorney Troy R. Morley.
Marshall will serve 5 years of supervised release after completing his sentence and will pay a special assessment of $300 to the Federal Crime Victims Fund.
