Edwin Labaw, Felon in Possession of Firearms, Massachusetts 2017

WORCESTER, MA – Edwin Labaw, 33, of Gardner, Massachusetts, is facing a decade behind bars after pleading guilty today to a federal firearm offense. Labaw admitted in federal court to being a felon in possession of firearms, a charge stemming from a brazen September 2017 operation where he peddled weapons to an undercover federal agent.

According to court documents, Labaw and accomplice Travis Miller, met with the agent on September 19, 2017, in Gardner. The pair unloaded a dangerous arsenal – a double-barrel 12-gauge shotgun, a 9mm Kel-Tech Sub 2000 rifle, and 11 rounds of 12-gauge shotgun ammunition – all for the price of $1,200. They weren’t finished. Just eight days later, on September 27, 2017, in Fitchburg, Labaw and Miller doubled down, selling a 7.62x39mm caliber SKS rifle, complete with ammunition and magazines, for a cool $1,800.

This wasn’t a one-time slip-up. Labaw, already saddled with prior felony convictions, knew full well he was prohibited from possessing firearms and ammunition. He knowingly skirted the law, turning a profit from the illicit arms trade. The feds caught wind of the operation, arresting both Labaw and Miller in November 2017.

While Labaw has now admitted guilt, his co-conspirator, Travis Miller, remains a threat. Miller is also facing federal charges – being a felon in possession of ammunition and distribution of fentanyl. He’s due back in court on March 22, 2018. Expect more details on his case to surface soon.

U.S. District Court Judge Timothy S. Hillman has scheduled Labaw’s sentencing for July 9, 2018. He faces a maximum sentence of 10 years in prison, three years of supervised release, and a hefty $250,000 fine. However, the final sentence will be determined by Judge Hillman, taking into account U.S. Sentencing Guidelines and other relevant factors.

The case was spearheaded by United States Attorney Andrew E. Lelling and Mickey D. Leadingham, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives, Boston Field Division. Local law enforcement – the Worcester, Gardner, Fitchburg Police Departments, and Massachusetts State Police – provided critical support. Assistant U.S. Attorney Bill Abely, from Lelling’s Worcester Branch Office, is prosecuting the case. Remember, these are allegations until proven guilty in a court of law.
