A Brandon man has been sentenced to 5 years in federal prison for his role in attempting to receive child pornography, according to a statement from the U.S. Attorney’s office.
Gatlin Wayne Herrera, 31, was convicted of Attempted Receipt of Child Pornography after using his cell phone to request the explicit content from an undercover agent posing as a 14-year-old female.
The attempted receipt occurred between March 7, 2022, and March 16, 2022.
Herrera pleaded guilty to the charges on November 30, 2023.
U.S. District Judge Karen E. Schreier handed down the sentence on March 14, 2024. As part of his sentence, Herrera will also serve 5 years of supervised release and be required to register as a sex offender.
Herrera was immediately remanded to the custody of the U.S. Marshals Service.
The case was investigated by Homeland Security Investigations, with the assistance of various law enforcement agencies, including the Internet Crimes Against Children Task Force, the South Dakota Division of Criminal Investigation, and the FBI.
Assistant U.S. Attorney Jeffrey C. Clapper prosecuted the case as part of Project Safe Childhood, a nationwide initiative to combat child sex exploitation and abuse.
The U.S. Attorney’s office emphasized the importance of holding individuals accountable for their crimes, particularly those that involve the exploitation of children.
