BOSTON, Massachusetts – In a devastating verdict, Gene Svirskiy, 37, of Ashland, Massachusetts, a former pharmacist at the New England Compounding Center (NECC), was convicted of racketeering, racketeering conspiracy, 10 counts of mail fraud, and two counts of introduction of adulterated drugs into interstate commerce with intent to defraud or mislead. This verdict marks yet another step towards justice for the victims of the 2012 nationwide fungal meningitis outbreak.
The outbreak, which was the largest public health crisis ever caused by a pharmaceutical drug, resulted in the distribution of contaminated and deficient drugs that never should have been made or distributed. Svirskiy, along with his former colleagues, callously disregarded patient health by cutting corners and prioritizing profits over safety.
These defendants got away with their crimes by defrauding federal and state regulators. As a result, the jury found their fraudulent conduct wrong and deserving of punishment. The conviction of Svirskiy and his former colleagues serves as a reminder of the importance of prioritizing patient safety and adhering to quality standards in the pharmaceutical industry.
Gene Svirskiy faces a sentence of no greater than 20 years in prison. His sentencing is scheduled for March 11, 2018.
The convicted defendants included Gene Svirskiy, a former NECC clean room pharmacist, Christopher Leary, an NECC clean room pharmacist, Sharon Carter, NECC’s former director of operations, and Alla Stepanets, one of NECC’s verification pharmacists.
This verdict marks the 11th conviction of a former NECC owner, executive, or employee on federal criminal charges. The convictions serve as a testament to the dedication of law enforcement agencies, including the FBI, in combating fraud and abuse in the healthcare system.
