A South Dakota man has been sentenced for making threats to injure the wife and husband of a former arresting officer.
Graham Garnos, 41, was sentenced to time served (37 months), 3 years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100. The sentencing took place on June 11, 2018, by U.S. District Judge Roberto A. Lange.
Garnos was indicted by a federal grand jury on March 4, 2015. He pled guilty on March 19, 2018. The case was investigated by the Federal Bureau of Investigation and the South Dakota Division of Criminal Investigation. Assistant U.S. Attorney Meghan N. Dilges prosecuted the case.
In 2007, Garnos was arrested on felony drug charges. Over the last few years, Garnos has called, left voicemail messages, sent e-mails, and posted things on Facebook and YouTube, all discussing his hostility towards the arresting officer.
On February 22, 2015, Garnos called the cell phone of the wife of the arresting officer, who did not answer. Garnos left a long voicemail to the victim, where he was threatening to kill the victim and her husband.
Garnos was sentenced for Interstate Communications with Threat to Injure. The crime occurred in South Dakota. The sentencing and arrest took place respectively on June 11, 2018, and March 4, 2015.
