Guatemalan Man Pleads Guilty to Immigration Violations in Waco

A Guatemalan national, Pablo David Cajti-Tzoy, has pleaded guilty to violating U.S. immigration laws in a federal court in Waco, Texas.

Cajti-Tzoy, 37, was arrested on June 21 in Temple, Texas, after being encountered by the U.S. Immigration and Customs Enforcement (ICE) Waco Fugitive Operations Team, according to court documents.

Records showed that Cajti-Tzoy entered the United States through Houston in October 2019 as a Temporary Agricultural Worker (non-immigrant H-2A) and was issued a Form I-94 with authorization to remain in the country until January 3, 2020.

However, Cajti-Tzoy failed to notify the Attorney General in writing of his new address in Harker Heights, Texas, after moving in December 2021. He was also not in possession of his I-94 when he was encountered by ICE officers.

Cajti-Tzoy pleaded guilty to one count of failure to notify of an address change and one count of failure to carry his alien registration on his person. Both charges are misdemeanors, carrying a maximum penalty of 30 days in federal prison.

U.S. Magistrate Judge Derek T. Gilliland sentenced Cajti-Tzoy to time-served. The case is part of Operation Take Back America, a nationwide initiative that aims to combat illegal immigration, eliminate cartels and transnational criminal organizations, and protect communities from violent crime.

U.S. Attorney Justin R. Simmons for the Western District of Texas made the announcement, stating that the case is a clear example of the Department of Justice’s commitment to enforcing immigration laws and protecting American communities.

Assistant U.S. Attorney Mark Frazier prosecuted the case, which was investigated by ICE.
