A 35-year-old man from Cabins, West Virginia, has been caught with a pistol and could spend the next 15 years behind bars for violating federal firearm laws.
Wesley Shane Haggerty, 35, of Cabins, West Virginia, pleaded guilty to the unlawful possession of a firearm, a crime that puts him in direct conflict with a string of prior felony convictions and misdemeanor domestic battery convictions.
According to court documents, Pendleton County Sheriff’s deputies responded to a home on a report of a man waving a gun. When officers arrived, Haggerty fled on foot with a pistol and was apprehended after a short chase.
Haggerty’s possession of a firearm puts him squarely in the crosshairs of federal authorities, who have made it clear that he is prohibited from owning a gun due to his extensive rap sheet.
The Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Pendleton County Sheriff’s Office led the investigation into Haggerty’s activities.
Assistant U.S. Attorney Stephen Warner will prosecute the case on behalf of the government, and U.S. Magistrate Judge Michael John Aloi will ultimately determine Haggerty’s sentence after reviewing the U.S. Sentencing Guidelines and other statutory factors.
A federal district court judge will determine Haggerty’s sentence, a decision that could have far-reaching consequences for the 35-year-old defendant. As he faces up to 15 years in prison, Haggerty must come to terms with the reality of his actions and the very real possibility that he will spend a significant portion of his life behind bars.
