Skylar Tarr McElwrath, Child Pornography Possession, TX 2023

BROWNSVILLE, Texas – The digital filth he hoarded earned Skylar Tarr McElwrath a one-way ticket to federal prison. The 22-year-old Harlingen resident was sentenced today to 72 months behind bars for possessing child pornography, U.S. Attorney Ryan K. Patrick announced. This isn’t a victimless crime; it’s the exploitation of the most vulnerable, and the justice system is finally responding.

McElwrath pleaded guilty on February 21, 2018, admitting to the sickening content he possessed. The investigation began around July 20, 2017, when authorities flagged suspicious activity related to the sharing of child pornography, eventually leading them to McElwrath’s Harlingen address. A subsequent search warrant uncovered a trove of digital depravity.

Forensic analysis of seized computers and digital devices revealed approximately 80 images and 15 videos depicting the sexual abuse of children. The sheer volume of material underscores the depravity of McElwrath’s actions and the harm inflicted upon the young victims featured within. He’ll have plenty of time to reflect on his choices within the confines of a federal penitentiary.

U.S. District Judge Rolando Olvera Jr. didn’t just hand down a prison sentence. McElwrath was ordered to pay $3,600 in restitution to a known victim – a small recompense for unimaginable trauma. Following his release, he’ll face 12 years of supervised release, subject to strict conditions restricting his access to children and the internet. He will also be required to register as a sex offender, a permanent mark of his heinous crime.

The case was spearheaded by Immigration and Customs Enforcement’s Homeland Security Investigations – Rio Grande Valley Child Exploitation Task Force, operating under the umbrella of Project Safe Childhood. This nationwide initiative, launched in 2006, is a concerted effort by the Department of Justice to dismantle the networks that enable child sexual exploitation and bring predators to justice. It’s a grim task, but one that’s absolutely necessary.

Assistant U.S. Attorneys Jason Corley and Ana C. Cano prosecuted the case. McElwrath was permitted to remain on bond and will voluntarily surrender to a U.S. Bureau of Prisons facility to be determined.
