
Grimy Times has learned that two men have been charged with illegally re-entering the United States following deportation or removal.
According to a grand jury indictment, 47-year-old Hector Sanchez-Soto, formerly of Cleveland, Ohio, was illegally present in the United States on January 5, 2013, after being previously deported due to a conviction for the commission of illegal re-entry following deportation or removal.
The indictment alleges that Sanchez-Soto re-entered the country despite being subject to a final order of removal issued by immigration authorities.
An indictment is only a charge and is not evidence of guilt. A defendant is entitled to a fair trial in which it will be the government’s burden to prove guilt beyond a reasonable doubt.
The case against Sanchez-Soto is being handled by Assistant United States Attorney Lauren Bell after an investigation by United States Immigration and Customs Enforcement.
The U.S. government has charged Sanchez-Soto with one count of illegal re-entry following deportation or removal, in violation of 8 U.S.C. § 1326(a). If convicted, the defendant’s sentence will be determined by the Court after review of factors unique to the case, including the defendant’s prior criminal record, if any, the defendant’s role in the offense, and the characteristics of the violation. In all cases, the sentence will not exceed the statutory maximum and in most cases it will be less than the maximum.
Sanchez-Soto is currently a fugitive and his whereabouts are unknown. The U.S. Marshals Service is seeking the public’s assistance in locating him.
