Herby Paul, Felon in Possession of a Firearm, Massachusetts 2021

BOSTON, MA – A Malden man has been indicted on a federal firearms offense, accused of illegally possessing a firearm.

The indictment, handed down by a federal grand jury, charges Herby Paul, 27, with being a felon in possession of a firearm and ammunition. Paul was detained following an initial appearance yesterday before U.S. District Court Magistrate Judge Marianne B. Bowler.

According to the indictment, on or about November 24, 2021, in Canton, Paul possessed a semiautomatic handgun and 13 rounds of ammunition. Paul is prohibited from possessing a firearm due to prior felony convictions.

The charge of being a felon in possession of a firearm and ammunition provides for a sentence of up to 10 years in prison, up to three years of supervised release, and a fine of up to $250,000. Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and statutes which govern the determination of a sentence in a criminal case.

Assistant U.S. Attorney Charles Dell’Anno of U.S. Attorney Rachael S. Rollins’ Major Crimes Unit is prosecuting the case.

The details contained in the indictment are allegations. The defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.

Paul’s current status is that he is detained following an initial appearance. The outcome of the case is pending trial and sentencing. If convicted, Paul faces a prison sentence of up to 10 years, supervised release of up to three years, and a fine of up to $250,000.
