BUFFALO, N.Y. — The grim halls of justice were once again filled with the sound of conviction as Marvin Jose Espana, a 46-year-old citizen of Honduras, stood before U.S. District Judge Richard J. Arcara and pleaded guilty to the heinous crime of illegal re-entry into the United States.

Espana, whose life has been a string of legal transgressions, was sentenced to time serve and handed over to Immigration and Customs Enforcement (ICE). This plea comes as no surprise to law enforcement officials who have long sought to bring him to justice.

Assistant U.S. Attorney Colleen M. McCarthy, the relentless prosecutor handling this case, emphasized that Espana is an alien without any legal status in our great nation. A native and citizen of Honduras, his removal from the United States was documented twice before — first in June 2007, and again in August 2014. Yet, like a ghost haunting the shadows, he reappeared on April 15, 2025, in Erie County within the Western District of New York.

This latest transgression is not an isolated incident but part of Operation Take Back America, a nationwide initiative aimed at repelling the invasion of illegal immigration, eliminating cartels and transnational criminal organizations (TCOs), and safeguarding our communities from violent crime.
